Lawyer Moses Richard Johnson, the defence lawyer for Bintou Jallow, former treasurer at CFAO Gambia Limited and first accused person in the ongoing criminal trial involving the state against her and Baboucarr Gai of Gaiyen Financial Services, Monday ended his cross-examination of Buba Ceesay, the first prosecution witness in the trial at the Banjul Magistrates’ Court.

Testifying before Magistrate Lamin Mbye Snr, PW1 told the court that during the course of their investigation they discovered that an amount of seven hundred and sixty eight thousand, five hundred and seventy five Dalasis was received by the first accused from Gaiyen Financial Services and was not deposited to any of CFAO Company account.

According to him, he doesn’t know that the amount in question was paid in CFAO Company account as put to him, further claiming that he does not check the monthly management records of CFAO Company; but that the second accused confirmed that anytime he gave the first accused money either at Guaranty Trust Bank (GTB) or other banks, he would

always call his cashier and asked him to draw a cheque for Bintou before asking Bintou to go and receive the said money.

The witness said he had investigated the assertion of the second accused which had been confirmed through the cashier.

When asked as to whether he made confirmation to the cashiers he responded in the negative.

The witness however admitted that the receipts he made reference to were not properly documented, as put to him by defence lawyer.

He also explained that in the course of their investigation, he spoke to one Momodou Musa Njie and that the latter stated he was the one who introduced Baboucarr to Bintou Jallow, maintaining that Baboucarr was introduced to Binta Jallow instead of Muhammed Mbaye, the Financial controller of CFAO Gambia limited.

When put to him that Gayen Financial Services had acted no time to have cause to deal with the first accused rather than CFAO Company, PW1 said the first accused was representing CFAO, and that he can’t remember how long the first accused was kept in their office, and that before commencing interrogation, the first accused was told that she has the right to speak to a lawyer, but she was silent.

The Fraud Squad SO maintained further that their investigation was thorough, while denying the fact that not because he spent less than 9 months with no experience in Financial Fraud investigation, his investigation lack skill management to carry out, as put by defence lawyer for the first accused.

Under cross-examination by Lawyer LS Camara, the witness said the second accused doesn’t work with CFAO.

Hearing continues on Wednesday 2014.
